I have no legal background, but I would think that after EQLive shuts down, it will be considered abandonware... the way I think of it is, on what grounds could it hold up in court, especially if they claim that they are loosing money from it... especially considering they would not get any income from EQLive once it shuts down

Copyright law, as it pertains to distributing warez, would still be in effect after a shutdown.

There have been all kinds of opinions from one extreme to the other on how enforceable the EULA is... but one thing's for certain: the day Sony shuts down EQ, they go into default on their EULA, hence any obligations you have under the EULA are then void.
