Default I was banned from their IRC server for "ASKING FOR WARE

Why do you guys even have IRC if you're just going to let a couple misfits dominate the channel with their iron fist of glory, just waiting to play hero and ban some l337 h4x0r who was looking to break the law... IT WAS A DAY LIKE ANY OTHER DAY as captain idiot rushes to the rescue and totally foils my plan to get WAREZ... not

I asked for certain patch files FROM the everquest directory, which of course I did purchase EVERQUEST. This would only be warez if I didn't purchase anything. Ive already purchased the rights to that software, and I can recieve it from anyone whos willing to send it LEGALLY! Im not asking for the entire directory, just a couple minutes is all itll take to send the files needed. I guess thats a bit too much to ask in an IRC channel, whereas no one cared to even explain to me that what I was doing was frowned upon in the channel.

Either way, can't wait till the new patch comes out I guess.

Actualy you were asking for patch file that were downloaded from SOE that SOE owns not you, Asking for people to send you warz is against the rules and is one of the main reasons SOE dont shut us down, i we started handing out there files they would sue and EMU would be shut down.

Well, it doesnt matter how legal it is. it's against the rules.

if the rules said "You must cluck like a chicken before using EQEmu" then you would have to do that or face getting banned (i wouldnt do this lol, just an analogy)...

That aside, banning without any warning is a little harsh..

it doesnt matter whether you own a legal license to the files you are receiving or not. If the person is sending files that are copyright protected it is ILLEGAL TO DISTRIBUTE THEM. Go read Sony's EULA and TOS.

The End User License Agreement (EULA) simply states I MUST OWN EVERQUEST TO USE THE FILES. It doesn't say no third party is allowed to distribute them. Im sorry you guys are all wrong. Ive ran my own online game(Anyone hear of Dungeon Falls?), and paid a lawyer $135 an hour to write a GOOD EULA. Some things you can put in it, other things you can't. Suchas you cannot put things like if you click okay, I instantly own your house. Also, if you are not over 18, you are NOT LEGALLY BOUND to any online document that you click I agree to. Therefore, it doesnt matter if they say you MUST BE 18, because no action can be taken against you.

Good news for porn users that are underage I guess. As for the rest of you... thanks for all the compassion and warning before youve decided to totally blow everything out of proportion and ban me from the IRC channel for asking for a little help. If this was a service you were trying to get people to like... I would not be a returning customer. However this is freeware, which means you get to treat me in whatever fashion you wish and I have to bend over and take it like I was Liberachi.

And how exactly are we supposed to prove to Verant that once we start passing out files, that every person that downloaded them were legimate, paying customers? Once they decide that they don't like us passing around the files necessary to anyone at random that allows people to bypass their livlyhood and play on our emulator?

I agree that the rash of bannings have been a bit harsh, but this has been an age old rule in eqemu that everyone is inflexible on, and for a reason. We try to keep this project as free of possible entanglements as we can.

As i see it in the log files, It looks like DrPlump Banned you as a joke (He didnt kick you.) And then jdankanyin read up, saw you ask for warez, and kicked you, not noticing you had already been banned. Usually everyone gets 1 warning.

I unbanned you this morning from the IRC. Consider this Warning #1.
